Terms of Service

1. Applicability

These Terms of Service (“Terms”) govern the conditions for use of Nestory Arc (“Service”). Users must agree to these Terms before using the Service, and are deemed to have agreed upon first use.

2. Service Overview

The Service is a cloud service for the secure storage, delivery, and sharing of photos and videos. Users can upload files and deliver them to clients and others via share links.

3. Account

  • Using the Service requires registration with an email address or Google account
  • Users are responsible for properly managing their account credentials and preventing unauthorized disclosure
  • If unauthorized use of an account is discovered, please change your password immediately and notify us
  • One user may not hold multiple accounts

4. Prohibited Activities

Users must not engage in any of the following activities.

  • Uploading or sharing content that violates laws or public morality
  • Handling child sexual abuse material (CSAM) or other illegal content
  • Uploading content that infringes on third-party copyrights, trademarks, privacy rights, or other rights
  • Uploading viruses, malware, or other harmful programs
  • Placing excessive load on the Service's servers
  • Unauthorized access, reverse engineering, or crawling of the Service
  • Unauthorized access to or impersonation of other users' accounts
  • Spam or other nuisance activities
  • Using the Service for commercial advertising or solicitation

5. Content Rights

  • Copyright to files uploaded by users belongs to the user or the rightful rights holder
  • The Service processes and stores files only to the extent necessary to provide the service
  • The Service does not sell or provide user content to third parties
  • Users warrant that they hold the necessary rights and permissions for all content they upload

6. File Management and Deletion

  • Files moved to trash are retained for 7 days and then automatically and permanently deleted
  • When an account is deleted, all files, albums, and personal information are permanently deleted
  • Files identified as viruses or malware will have viewing and downloading automatically blocked
  • If illegal content is confirmed, files may be deleted and accounts suspended without prior notice

7. Sharing Features

  • Share links are accessible to anyone who knows the link. Users are responsible for managing who they share links with
  • Access can be restricted by setting passcode protection
  • An expiry date can be set on share links
  • Users who generate a share link are also responsible for activities conducted via that link

8. Disclaimer

  • The Service is provided “as is” and does not guarantee fitness for a particular purpose, uninterrupted operation, or error-free performance
  • Users are responsible for backing up their own data. The Service is not liable for data loss
  • The Service may be temporarily suspended due to maintenance or failures
  • The Service is not responsible for issues caused by third-party services (cloud infrastructure, virus scan engines, etc.)

9. Service Changes and Termination

The operator may change the content of the Service or terminate it without prior notice. In the event of service termination, users will be notified in advance where possible. The operator is not liable for any damages incurred by users due to service termination.

10. Changes to Terms

These Terms may be updated without prior notice. In the event of significant changes, users will be notified within the Service or by email. Continued use of the Service after changes constitutes acceptance of the revised Terms.

11. Paid Plans and Payments

  • Paid plans (Lite and Pro) are monthly auto-renewable subscriptions
  • iOS app: Subscriptions are purchased through Apple In-App Purchase and billed to your Apple ID account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Payment will be charged to your Apple ID account within 24 hours prior to the end of the current period.
  • Web app: Payments are processed through Stripe, Inc. Credit card information is not stored on our servers; Stripe manages it securely.
  • Billing occurs at the time of registration and automatically renews monthly.

12. Cancellation and Refund Policy

  • iOS app: Subscriptions can be managed and auto-renewal turned off by going to your Account Settings in the App Store after purchase. Cancellation must be made at least 24 hours before the end of the current period.
  • Web app: Paid plans can be canceled at any time from the Settings page within the app.
  • After cancellation, paid plan features remain active until the end of the current billing period.
  • No pro-rated refunds are issued for mid-period cancellations.
  • For iOS purchases, refund requests are handled by Apple in accordance with their policies.
  • Downgrade to the free plan occurs automatically at the end of the billing period after cancellation.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the court having jurisdiction over the operator's location.
